Netizency.com is a digital marketing platform owned and operated by Netizency, designed to ensure that Users appear online to the right people at the right time and place, and will be referred to hereinafter as “us”, “we”, “our”, “Netizency” or “Netizency.com”;

THE INFORMATION WE COLLECT

  • Netizency.com will not sell or rent any of your Personal Data to third parties. Netizency.com will not share any of your Personal Data with third parties except in the limited circumstances described below:

    • We share information with service providers under contract who help with our business operations, payment and order processing, IT and hosting, fraud investigation, bill collection, information management and analytics, providers of CRM, marketing and sales software solutions. If content generation is included in your Services, we may share information with service providers under contract to create, edit and/or publish such content. These third parties are obligated to protect your information and to use your Personal Data only as necessary to provide these services to Netizency.com. They are contractually prohibited from using your Personal Data for any other purpose and are never permitted to share your information with any third parties.

    • We disclose information that we, in good faith, believe is appropriate to cooperate in investigations of fraud or other illegal activity, to conduct investigations of violations of our Terms of Use and/or to protect our right, protect your safety and the safety of others.

    • We disclose information in response to a subpoena, warrant, court order, levy, attachment, order of a court-appointed receiver or other comparable legal process, including subpoenas from private parties in a civil action. If the subpoena seeks information about an identified subscriber or limited group of subscribers, we’ll make reasonable business efforts to contact the subscriber(s) before providing information to the party that requests it.     • The implementation of our Services, by its very nature, may require publishing your Personal Data in order to post review responses, post on social media sites, etc. For example, we may have to disclose your name to a review website in order to post a response to a review.

Netizency takes numerous precautions to protect our Users’ information. When Users submit sensitive information via the Website, such information is protected both on- and offline. Netizency goes to great lengths to ensure that no unauthorized parties can access information collected during the provision of services through the Website. All of our Users’ and Clients’ sensitive information is restricted in our offices. While Netizency employs commercially reasonable security measures to protect our data, and seeks to partner with companies which do the same, we cannot guarantee the security of any data transmission over the Internet or any wireless network. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure, and we, therefore, are not responsible for any breach of security or for any actions of any third parties that may receive any such information.

Cancellation; Term and Termination.

Netizency may, in its sole discretion, terminate User’s account or its access to or use of the Services, disable User’s account or access to the Services, remove all or a portion of any information that User provides to Netizency in connection with User’s use of the Services, such as User Content or Reviews, or put User’s account on inactive status, in each case at any time, with or without cause, with or without notice and without refund. Netizency shall have no liability to Use or any third party because of such termination or action, except that Netizency will refund a pro rata portion of any prepaid amounts if Netizency terminates User without cause or is unable to deliver the promised service. Refunds will be made onto the original mode of payment and will be processed within 10 to 45 days depends on the issuing bank of the credit card.

User may terminate or cancel the Services at any time by contacting Netizency customer support.  In such event, User shall be obligated to pay all fees and charges accrued prior to the effectiveness of such cancellation.

Fees and Payment Terms

The fees and packages applicable for the Services are available on the Netizency website and/or quoted to User by a Netizency sales representative and reflected in a subscription package.

It is User’s responsibility to ensure that its payment information is up to date and that any invoices are paid on time. User agrees to pay for the Services in advance of the time period during which such Services are provided.  Subject to applicable laws, rules, and regulations, payments received will be first applied to the oldest outstanding invoice in User’ billing account.

Unless otherwise provided, User agrees that until and unless it notifies Netizency of its desire to cancel the Services, it will be billed on an annually automatically recurring basis to prevent any disruption to its use of the Services, using the credit card or other billing information on file with Netizency. Any invoiced payments will be invoiced to User and payable upon receipt of invoice and if User fails to pay any amount due to Netizency within five days of its due date, Netizency may, at its option, suspend the Services or terminate this Privacy Policy.

If Netizency is for any reason unable to effect automatic payment, it will attempt to notify User and User account may be disabled or terminated until payment is received or Netizency may, in its discretion, place User’s account in “suspend” status and charge User based on the then-current suspend fee schedule.  If User fails to pay the fees as specified herein, Netizency may pursue the collection costs incurred by it, including any arbitration and legal fees, and reasonable attorneys’ fees. Netizency will have no obligation to activate new orders or activate new packages for customers who have an outstanding balance on their account.

If you make a payment for products or services on our Site, the details you are asked to submit will be provided directly to our payment provider via a secured connection.

You will receive a payment confirmation by Email directly after completing your online payment. All services will be delivered electronically thereafter.

THIRD PARTIES

Some of the advertisements you see on the Site are selected and delivered by third parties, such as ad networks, advertising agencies, advertisers, and audience segment providers. These third parties may collect information about you and your online activities, either on the Site or on other websites, through cookies, web beacons, and other technologies in an effort to understand your interests and deliver to you advertisements that are tailored to your interests. Please remember that we do not have access to, or control over, the information these third parties may collect. The information practices of these third parties are not covered by this privacy policy. Kindly remove any other statements that contradicts with the above statements.

NOTIFICATION OF CHANGES

If we decide to change our terms under this Privacy Policy, we will post those changes under the appropriate link on the home page of our Website, so our Users are always aware of what information we collect, how we use it, and under what circumstances if any, we disclose it.
